# Terms of Use

Effective: September 29, 2026

These Terms of Use (the "Terms") are a legal agreement between you and American River Gas Co., Inc. ("American River Gas," "we," "us" or "our"). They govern your access to and use of americanrivergas.com and the forms, tools and communications offered through it. Please read them carefully. They include important safety information, an explanation that website requests are not orders until our office confirms them, a disclaimer of warranties, a limitation of our liability, an indemnity from you, a choice of California law, a requirement that disputes be heard in Placer County, California, and a one-year time limit for claims about the Site. By using the Site, submitting a request or chatting with our website assistant, you agree to these Terms. If you do not agree, please do not use the Site. If you smell gas, do not use the Site at all: leave the building and, from outside, call 911 and then our office at (530) 888-7438.

## 1. Agreement to these Terms

Binding agreement. By accessing or using the Site in any way, including browsing its pages, submitting a form, requesting a delivery, opening an account application, chatting with our website assistant, tapping a telephone number or following a link to the My Account payment portal, you accept these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you use the Site on behalf of a business, a farm or ranch, a property owner, a tenant, a homeowners association or another person, you represent that you are authorized to accept these Terms on their behalf, and "you" includes that person or business.

Other terms. Additional terms may apply to particular programs, offers or features, such as the Budget Plan, autopay or the My Account payment portal, and those terms will be presented to you or made available to you when they apply. Propane supply, deliveries, tank arrangements and other Services are governed by your Account Paperwork, as explained in Section 10.

Relationship to your account. These Terms govern the Site. They do not replace, and are not replaced by, your Account Paperwork, except as Section 10 describes.

## 2. Definitions

In these Terms, the following words have the meanings below:

- "Site" means americanrivergas.com, including its pages, the plain-text (Markdown) versions of its pages, its llms.txt summary files, and any tools, forms, pop-ups, maps, accessibility tools and chat features offered on those pages.
- "Content" means all text, guides, frequently asked questions, safety information, service descriptions, program descriptions, maps, photographs, graphics, logos, designs, code and other material on the Site, and the selection and arrangement of that material.
- "Services" means the propane supply and related services we provide, including residential, commercial and agricultural propane delivery, automatic delivery programs, tank installation and tank sets, underground gas lines, leak checks and system checks, appliance conversions, and portable cylinder and RV refills.
- "Account Paperwork" means the customer application, credit application, tank lease or tank agreement, delivery program election, Budget Plan or autopay enrollment, invoices, statements and any other written agreement, form or document that you sign or accept in connection with your account or the Services, together with the terms we provide to you with them.
- "Request" means a form submission, pop-up form submission, account application submitted through the Site, delivery request, chat conversation, telephone call, voicemail, message left with our answering service or email through which you ask us for information or Services.
- "Submission" means any information, text, message, gauge reading, photograph, document or other material you send to us through the Site or by email, fax or telephone.
- "Chat Assistant" means Scout, the automated chat assistant on the Site, powered by YelloPost AI.
- "My Account Portal" means the online account and payment portal linked from the Site, which is operated by a third-party provider and not by us.
- "American River Gas Parties" means American River Gas Co., Inc. and its owners, officers, directors, employees, agents, successors and assigns, and its service providers, including our website provider, YelloPost.

## 3. About us

American River Gas Co., Inc. is a family-owned propane dealer located at 10290 Ophir Rd, Newcastle, CA 95658. Our mailing address is P.O. Box 4590, Newcastle, CA 95658. Our family has been in the propane business since 1966, when our founder, Don Veninga, began in the trade. We serve residential, commercial and agricultural customers in the communities listed on our Service Areas page.

Office hours. Our office is open Monday through Friday, 8:00 AM to 4:30 PM, and is closed from noon to 1:00 PM. After hours, on weekends and on holidays, our answering service reaches a staff member. Our telephone number is (530) 888-7438. Our fax number, (530) 888-1901, is for faxes only. Our email address is info@americanrivergas.com.

How to reach us about Services. Requests submitted through the Site are reviewed by our office during office hours. If your matter is time-sensitive, please call us rather than relying on a form, an email or the Chat Assistant. If your matter is a gas emergency, follow Section 5.

## 4. Eligibility and minors

You must be at least 18 years old, or the age of majority where you live, to submit an account application, to request a delivery or other Services, or to enter into Account Paperwork. The Site is not directed to children, and we do not knowingly collect personal information from children under 16. Individuals under 18 should not submit Requests or use the Chat Assistant without the involvement of a parent or guardian. If you are under 18 and you smell gas or believe anyone is in danger, leave the building, tell an adult and call 911 from a safe place.

## 5. Propane safety and emergencies

The Site is not an emergency service. The Site, its forms, the Chat Assistant, our email address and our fax line are not monitored for emergencies and must never be used to report a gas leak, a fire, a carbon monoxide concern or any other immediate danger.

If you smell gas or suspect a leak. Propane has an added odor, often described as smelling like rotten eggs, so that leaks can be noticed. If you smell gas or suspect a leak:

- Put out all smoking materials and other open flames, and do not create sparks.
- Do not operate light switches, appliances, thermostats, garage doors or telephones, including cell phones, in the area where you smell gas.
- Get everyone out of the building or area right away.
- If it is safe to do so, close the main gas supply valve on your propane tank or cylinder.
- From a safe location away from the building, call 911 and then call American River Gas at (530) 888-7438. After office hours, our answering service reaches a staff member.
- Do not return to the building or area until a qualified service technician or emergency responder tells you it is safe.
- Before your system is used again, have it checked by a qualified service technician, who can test for leaks and relight pilot lights.

Carbon monoxide. If a carbon monoxide alarm sounds or anyone shows symptoms such as headache, dizziness, nausea or drowsiness that may be related to an appliance, get everyone into fresh air and call 911. Content about carbon monoxide on the Site is general and does not replace working carbon monoxide alarms, which should be installed and maintained according to their manufacturers' instructions and applicable law.

Safety information is general. Safety guidance on the Site, including the steps above and the information on our Propane Safety and Smell Gas pages, is general information offered to help you. Follow it only if you can do so safely, and always follow the directions of emergency responders. Nothing on the Site asks you to inspect, repair, adjust, move, connect or disconnect propane tanks, regulators, gas lines or appliances yourself. That work should be done only by qualified personnel.

## 6. The Site is for general information only

No professional advice. The Content, including service and program descriptions, guides, frequently asked questions, safety information, maps and responses from the Chat Assistant, is provided for general informational purposes only. It is not engineering, code-compliance, legal, financial, tax or other professional advice, and it is not a substitute for an inspection of your property, tank, gas lines or appliances by a qualified technician. Every property, installation and propane system is different.

No reliance for specific decisions. You should not make decisions about the installation, relocation, sizing or use of propane equipment, or about your safety, based solely on the Content. Consult our office or another appropriate qualified professional, and follow the requirements of your local building and fire officials, when your situation calls for it.

Equipment and appliances. Descriptions on the Site of tank sizes, gas lines, appliance conversions and other equipment are general. Whether a particular tank, location, line or appliance is suitable for your property depends on an assessment by qualified personnel, on the manufacturer's requirements, and on applicable codes, setback rules and local permitting requirements.

Accuracy and timeliness. We try to keep the Content accurate and current, but it may contain errors, omissions or outdated information, and it may change without notice. If anything on the Site differs from what our office tells you or from your Account Paperwork, what our office confirms and your Account Paperwork control.

## 7. Requests are not orders until our office confirms them

A Request is only a request. Submitting a form on the Site, including an account application or a delivery request, chatting with the Chat Assistant, leaving a message or receiving an automatic confirmation email is a request for information or Services. It does not create an order, an account, a delivery appointment or a contract, and it does not obligate you or us to proceed.

Confirmation. A Request becomes an order, a scheduled delivery or an open account only when our office confirms it with you. New accounts may be subject to our application and approval process and to Account Paperwork. We may decline or delay a Request for any lawful reason, including safety concerns, access to the property, the location of the property, credit or account status, or supply and scheduling constraints.

Automatic confirmation emails. If you give us an email address, the Site may send you an automatic email confirming that we received your Request and describing general next steps. That email confirms receipt only. It is not a confirmation of an order, a price, a delivery date or an account.

Accurate information. When you submit a Request, you represent that the information you provide, including any tank gauge reading, account number, service address and description of your property, tank and appliances, is accurate and complete to the best of your knowledge, and that you are authorized to request Services for the property involved.

## 8. Prices, quotes and the propane market

Prices are quoted by our office. The Site does not publish binding propane prices. Prices for propane and related Services are quoted by our office, and a price applies only when our office quotes or confirms it to you or it is stated in your Account Paperwork.

Prices change with the market. Propane prices change with the propane market and can change between the time you contact us and the time of delivery, unless your Account Paperwork provides otherwise. Descriptions on the Site of what a full-service propane price may include, or of the factors that affect cost, are general information. They are not estimates, quotes, bids or offers, and they do not bind us.

Taxes and charges. Quoted prices may be subject to applicable taxes and to other charges described in your Account Paperwork or explained to you by our office.

## 9. Deliveries, scheduling and access

Delivery programs. The Site describes delivery programs, such as Keep Full automatic delivery, in general terms. The program that applies to your account, and its terms, are set by your Account Paperwork and confirmed by our office.

Delivery days and timing. Delivery days depend on our route schedule, your location, weather, road conditions, demand and other factors. Any statement on the Site, in the Chat Assistant, in a confirmation email or on a call about when a delivery will arrive or how quickly we can respond is a good-faith goal or general estimate, not a guarantee. Our office will confirm the day our route truck is in your area.

Ordering in time. For customers who order their own deliveries, it is your responsibility to monitor your tank gauge and to request a delivery early enough to avoid running low. Guidance on the Site about when to order is general, and the right timing for your household or business depends on your usage, the season and your tank. If you run out of propane, your system may need a leak check before it can be relit, as required by safety practice and applicable rules.

Access to your tank. To allow a safe delivery, please keep the path to your tank clear and let our office know about gates, locks, dogs, road or driveway conditions and anything else that may affect access. We may be unable to complete a delivery if the tank cannot be reached safely.

## 10. Accounts, billing and your Account Paperwork

Account Paperwork controls. Propane supply, deliveries, tank arrangements, payment terms, the Budget Plan, autopay, fees and the other terms of your relationship with us as a customer are governed by your Account Paperwork, not by these Terms. The Payment Options and Budget Plan pages on the Site describe those programs in general terms for your convenience. If anything on the Site differs from your Account Paperwork, your Account Paperwork controls.

Order of precedence. If there is any conflict between these Terms and your Account Paperwork, your Account Paperwork controls with respect to the Services and your account. These Terms continue to govern your use of the Site.

Authority. By submitting an account application or signing Account Paperwork, you represent that you are authorized to open the account and, where tank installation or other work at a property is involved, that you own the property or are authorized by its owner to request that work.

Billing questions. If you have a question about a bill, a statement or your account balance, please call our office during office hours. The Chat Assistant cannot see your account and cannot answer questions about your balance, your deliveries or your payments.

## 11. The My Account payment portal

Third-party portal. The Site links to the My Account Portal, where existing customers may view account information and make payments. The My Account Portal is operated by a third-party provider on its own systems, at its own web address, and under its own terms of use and privacy practices. It is not part of the Site, and these Terms do not govern it.

Your use of the portal. Information you enter in the My Account Portal, including payment card or bank account details and login credentials, is handled by the portal provider under its own terms and is not collected by the Site's forms. You are responsible for keeping your portal login credentials confidential and for activity under your login.

Availability. We do not control the availability, security or performance of the My Account Portal. If you cannot use it, please call our office for other ways to pay, which are described on our Payment Options page.

Never send payment details through the Site. Please do not enter payment card numbers, bank account numbers, Social Security numbers or passwords into any form on the Site or into the Chat Assistant.

## 12. Tanks, equipment and work at your property

General descriptions. Content about tank installation, tank sets and transfers, underground gas lines, leak checks and appliance conversions describes our Services in general terms. The scope of any work, and the conditions for it, are confirmed by our office and set by your Account Paperwork.

Leak test before the first fill. As described on the Site, every new customer set-up includes a leak test before the first fill. Other safety checks, such as a leak check after an interruption of service, may be required by safety practice or applicable rules.

Equipment you own and equipment we provide. Whether a tank is leased from us or owned by you affects responsibilities for filling, maintenance and other matters. Those responsibilities are set by your Account Paperwork and applicable law, not by the Site.

Your responsibilities. You agree not to tamper with, move, alter, paint over safety markings on, or connect equipment to a propane tank, regulator or gas line except as permitted by your Account Paperwork and applicable law, and to tell our office promptly about any change to your appliances, any damage to your system, or any condition that may affect its safe operation.

## 13. Portable cylinders and RV refills

Cylinders are filled at our yard at 10290 Ophir Rd in Newcastle during office hours, Monday through Friday, 8:00 AM to 4:30 PM, closed from noon to 1:00 PM. Whether a particular cylinder can be filled depends on its type, condition, markings and the safety rules that apply to it, as determined by our personnel at the time of filling. Information on the Site about cylinders is general. Please transport cylinders upright and secured, keep them out of enclosed spaces, and follow the safety instructions our personnel give you.

## 14. The Chat Assistant

Automated tool. The Chat Assistant, Scout, is an automated tool powered by YelloPost AI, an artificial-intelligence service provided through our website provider, YelloPost. It is not a person, and it is not a licensed or certified professional of any kind.

May be inaccurate. Responses from the Chat Assistant are generated automatically. They are general information and may be incomplete, out of date or inaccurate, and they may occasionally be inconsistent with the Content or with what our office tells you. Please confirm anything important with our office.

Not binding. The Chat Assistant cannot see your account, place orders, schedule deliveries, quote or change prices, approve an account, or make any other binding commitment. Nothing it says creates a contract, confirms a delivery, sets a price or commits to a timeline. Only our office, or your Account Paperwork, can do those things.

Not for emergencies. The Chat Assistant cannot respond to emergencies. If you smell gas, stop chatting and follow Section 5.

Your conversations. When you use the Chat Assistant, the contents of the conversation are processed as described in our Privacy Policy. If you share your name and telephone number or email address, the details are sent to our office so that a person can follow up. Please do not enter payment card numbers, bank account numbers, Social Security numbers, passwords or other sensitive information into the chat.

Proper use. You agree not to use the Chat Assistant to generate content unrelated to propane, your property or our Services, to attempt to make it produce harmful, unlawful or misleading content, or to attempt to circumvent its safeguards.

## 15. Contacting you about your Request

Your contact information. When you submit a Request, you represent that you are the subscriber or authorized user of the telephone number and email address you provide.

Follow-up about your Request. By submitting a Request with your telephone number or email address, you ask and agree that American River Gas may contact you by telephone or email about your Request, your account and any resulting Services, including scheduling, deliveries, safety matters and billing. If you give us an email address, you will also receive an automatic confirmation that we received your Request.

Your choices. You may ask us at any time to stop contacting you by a particular method by telling us on a call or by emailing info@americanrivergas.com. If you have an active account or a scheduled delivery, limiting how we can reach you may affect our ability to contact you about it, and we may still send communications that are required by law or needed for your safety.

Changed numbers. If the telephone number or email address you gave us changes or you stop using it, please tell us promptly so that we do not contact someone else.

## 16. Electronic communications and signatures

Consent to electronic communications. By using the Site or submitting a Request, you consent to receive communications from us electronically, including by email and postings on the Site, and you agree that notices, disclosures, confirmations and other communications we provide electronically satisfy any legal requirement that they be in writing, to the extent permitted by law, including the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and the California Uniform Electronic Transactions Act.

Electronic signatures. If you sign Account Paperwork or another document electronically, you agree that your electronic signature is the legal equivalent of your handwritten signature.

Paper copies and withdrawal. You may ask for a paper copy of any document you have signed with us, and you may withdraw your consent to receive electronic communications, by contacting us as described in Section 48. Withdrawing consent does not affect the validity of electronic communications or signatures provided before the withdrawal.

Keeping your contact information current. You are responsible for giving us a working email address and telephone number and for keeping them current. To receive our emails, you need a device with internet access and an email account.

## 17. Submissions

Your ownership. You keep ownership of the Submissions you send us.

License to us. You grant the American River Gas Parties a non-exclusive, royalty-free, worldwide license to use, copy, store, transmit, display and share your Submissions as needed to respond to your Request, open and service your account, plan and perform Services, bill for Services, keep business and safety records, protect the Site, and comply with law, as described in our Privacy Policy.

No publication without permission. We will not publish your name, your comments or identifiable photographs of your property on the Site, on social media or in advertising without your permission.

Your responsibility. You represent that you have the right to send us each Submission and to grant the license above, and that your Submissions do not violate anyone's rights or any law. Do not send information about other people without their permission, and do not send content that is unlawful, obscene or harmful.

No obligation to review. We may, but are not required to, review or keep Submissions, and we may delete or decline to act on any Submission that violates these Terms.

## 18. Feedback

If you send us suggestions, ideas or other feedback about the Site or our Services, you agree that we may use, share and act on that feedback for any purpose without obligation or payment to you. This does not give us any right to publish your personal information or a review in your name without your permission.

## 19. Acceptable use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

- Use the Site in any way that violates any applicable federal, state, local or international law or regulation.
- Submit false, misleading or fraudulent Requests or account applications, or submit a Request about a property or on behalf of a person without authorization.
- Impersonate any person or business, including any American River Gas employee, or misrepresent your identity or your affiliation with any person or business.
- Use the forms, the Chat Assistant, our email address, our fax line or our telephone number to send spam, unsolicited sales pitches, advertising, solicitations for business or chain messages.
- Submit Requests or chat messages by automated means, including bots, scripts or form-filling software, or submit repeated or duplicate Requests intended to burden our office.
- Interfere with, disable, bypass or attempt to defeat Cloudflare Turnstile, our automated screening or any other security, anti-abuse or access-control feature of the Site.
- Scrape, crawl, copy, harvest or collect Content or data from the Site by automated means, except that search engines and AI assistants may index publicly available pages in accordance with the instructions in our robots.txt file.
- Copy the Site's design, layout, code or Content for use on another website.
- Reverse engineer, decompile, disassemble or attempt to discover the source code of any non-public part of the Site or its tools, except to the extent the law expressly permits it despite this restriction.
- Attempt to gain unauthorized access to the Site, the servers that host it, the My Account Portal, our systems or any information about other visitors or customers.
- Upload, transmit or introduce viruses, malware or other harmful code, or conduct any denial-of-service or similar attack.
- Use the Site in any manner that could damage, disable, overburden or impair it or interfere with anyone else's use of it.
- Frame or mirror the Site, or use our name, logo or Content in a way that suggests we endorse or are affiliated with you or your products or services.
- Harass, threaten, abuse or use hateful or obscene language toward our team through the Site, the Chat Assistant, our telephone number or email.
- Use the Site to collect information about other people.
- Encourage or help anyone else to do any of the above.

## 20. Automated screening and security features

Requests submitted through the Site are automatically screened for spam, abuse, duplicate submissions and unsolicited sales solicitations, and our forms use Cloudflare Turnstile, a bot-detection check that usually works without any action from you. A message flagged by screening may be held, may be delayed and may not be delivered, and a duplicate of a Request you recently sent may be recorded without being sent to our office a second time. Screening is imperfect and may occasionally hold a genuine Request. If you have submitted a Request and have not heard from us within a reasonable time, please call us at (530) 888-7438 during office hours. We are not responsible for Requests that are not delivered because of screening, technical problems, incorrect contact information or circumstances outside our control.

## 21. Our intellectual property

Ownership. The Site and its Content are owned by American River Gas Co., Inc. or by its licensors, including our website provider, and are protected by United States and international copyright, trademark and other intellectual property laws.

Limited license to you. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for your personal, non-commercial purposes, which include learning about propane and our Services, requesting Services, managing your relationship with us and sharing links to Site pages. You may print or save a reasonable number of pages for your own reference, provided you do not remove any copyright or other notices.

Restrictions. Except as allowed above or by law, you may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display, sell or otherwise exploit any Content, or the Site's design or code, without our prior written permission.

Photographs. Some photographs on the Site may be licensed images used to illustrate general conditions and Services, and may not depict our customers' properties or our equipment.

Reservation of rights. All rights not expressly granted in these Terms are reserved by us and our licensors.

## 22. Trademarks

"American River Gas," our logo and other names, logos and slogans on the Site that identify us are our trademarks or trade names. You may not use them without our prior written permission, except to refer accurately to us. Other names and marks that appear on the Site, such as those of appliance manufacturers, technology providers, review platforms and social networks, belong to their respective owners and are used only to identify them.

## 23. Copyright complaints

We respect the intellectual property rights of others. If you believe that material on the Site infringes a copyright you own or control, you may send a written notice to us by email at info@americanrivergas.com, with the subject line "Copyright Notice," or by mail to American River Gas Co., Inc., Attn: Copyright Notice, P.O. Box 4590, Newcastle, CA 95658. Consistent with 17 U.S.C. 512(c)(3), your notice should include:

- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work you claim has been infringed, or, if several works are covered by one notice, a representative list of them.
- Identification of the material you claim is infringing, with enough information for us to locate it, such as the page address.
- Your name, mailing address, telephone number and, if available, email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Counter-notices. If material you provided was removed in response to a notice and you believe it was removed by mistake or misidentification, you may send us a counter-notice that includes the information described in 17 U.S.C. 512(g)(3).

Misrepresentations. Under 17 U.S.C. 512(f), a person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please consider consulting an attorney before sending a notice or counter-notice.

## 24. Third-party names, links and content

Third-party names. The Site may mention other businesses, organizations and products by name, such as appliance and equipment manufacturers, only to identify them. Those names and marks belong to their owners. Their appearance on the Site does not mean that any of them endorses, sponsors or is affiliated with us, unless we say so expressly.

Links. The Site contains links to third-party websites and services, including the My Account Portal, Google, Facebook, maps and safety organizations. We provide links for convenience only. We do not control, endorse or assume responsibility for the content, accuracy, availability, privacy practices or terms of any third-party website. Your use of a third-party website is at your own risk and subject to its terms.

Search engines and AI assistants. Search engines, AI assistants and other third-party services may index, quote or summarize Content from the Site. We do not control those services, and we are not responsible for how they present, summarize or change our Content, or for any answer they give about us. If you rely on information about us from another service, please confirm it on the Site or by calling our office.

Third-party components. Parts of the Site rely on third-party services, such as Cloudflare Turnstile, Google Fonts, the ADAWebPro accessibility toolbar and, unless you choose "Essential only," Google Tag Manager and Google analytics and advertising measurement tools. Those services are provided by their owners under their own terms, and we are not responsible for their availability or performance.

## 25. Reviews and ratings

Ratings and reviews shown on or linked from the Site, such as our rating on Google, come from customers who posted them on third-party platforms. They reflect the individual experiences and opinions of those customers. They are not a guarantee, promise or prediction of the experience you will have. We do not control those platforms, and the ratings and number of reviews on them may change over time. If you post a review on a third-party platform, that platform's terms govern your review.

## 26. Service areas and maps

Descriptions of the areas we serve, including the service-area map, the list of towns on our Service Areas page and any distances or drive times shown, are general and approximate. They do not guarantee that we can serve every address in a listed area, on every day or in every condition, and we may serve properties outside the areas shown. Whether we can serve a particular property is confirmed by our office. Map boundaries, locations, distances and drive times are approximate.

## 27. Availability and changes to the Site

We may change, suspend or discontinue any part of the Site, the Content, the Chat Assistant or any other feature at any time, without notice and without liability to you. We do not guarantee that the Site will be available at any particular time or location, and the Site may be unavailable because of maintenance, updates, technical problems, third-party outages or events outside our control. When the Site is unavailable, you can still call us at (530) 888-7438.

## 28. Privacy

Our Privacy Policy explains how we collect, use, share and protect personal information, including information collected through forms, the Chat Assistant and analytics tools, your choices through the privacy banner and the Privacy choices link, how we honor Global Privacy Control signals, and the rights of California residents. By using the Site, you acknowledge the practices described in the Privacy Policy.

## 29. Accessibility

We want the Site to be usable by everyone, including people with disabilities. Our Accessibility Statement describes our goals, the accessibility features of the Site and how to get help. If you have difficulty using any part of the Site, please call us at (530) 888-7438 during office hours or email info@americanrivergas.com, and we will help you directly.

## 30. Suspension of access

We may block, restrict, suspend or terminate your access to all or part of the Site, including the forms and the Chat Assistant, at any time and without notice if we reasonably believe you have violated these Terms, are using the Site to send spam or solicitations, are harassing our team, or are creating risk or possible legal exposure for us or others. Suspension of access to the Site does not by itself change your account or your Account Paperwork. Sections of these Terms that by their nature should survive continue to apply after your access ends, as described in Section 46.

## 31. Disclaimer of warranties

THE SITE, THE CONTENT, THE CHAT ASSISTANT AND ALL OTHER FEATURES AND INFORMATION MADE AVAILABLE THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE AMERICAN RIVER GAS PARTIES DISCLAIM ALL WARRANTIES WITH RESPECT TO THE SITE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, THE AMERICAN RIVER GAS PARTIES DO NOT WARRANT THAT THE SITE OR ANY CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, UNINTERRUPTED, SECURE, TIMELY OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; THAT ANY REQUEST WILL BE RECEIVED, DELIVERED OR ANSWERED WITHIN ANY PARTICULAR TIME; OR THAT ANY RESPONSE FROM THE CHAT ASSISTANT WILL BE CORRECT OR SUITABLE FOR YOUR SITUATION.

THIS SECTION APPLIES TO THE SITE ONLY. ANY WARRANTY OR OTHER TERMS FOR PROPANE, EQUIPMENT OR SERVICES ARE STATED IN YOUR ACCOUNT PAPERWORK OR PROVIDED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

## 32. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE AMERICAN RIVER GAS PARTIES BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, THE CONTENT OR THE CHAT ASSISTANT, OR YOUR USE OF OR INABILITY TO USE ANY OF THEM, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE AMERICAN RIVER GAS PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

THE LIMITATIONS IN THIS SECTION APPLY TO YOUR USE OF THE SITE. THEY DO NOT APPLY TO PROPANE, EQUIPMENT OR SERVICES WE PROVIDE, WHICH ARE GOVERNED BY YOUR ACCOUNT PAPERWORK AND APPLICABLE LAW. NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER CALIFORNIA LAW OR OTHER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, WILLFUL INJURY TO THE PERSON OR PROPERTY OF ANOTHER, OR VIOLATION OF LAW WHERE THE LAW DOES NOT PERMIT IT TO BE LIMITED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

The disclaimers and limitations in Sections 31 and 32 are an essential part of the basis of the bargain between you and us, and they allow us to offer the Site and the Chat Assistant free of charge.

## 33. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless the American River Gas Parties from and against any claims, demands, actions, losses, liabilities, damages, judgments, settlements, costs and expenses, including reasonable attorneys' fees, arising out of or relating to (a) your violation of these Terms; (b) your misuse of the Site; (c) any Submission you send us, including any claim that a Submission infringes or violates the rights of a third party; (d) any false or misleading information you provide; or (e) your violation of any law or the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense. This Section does not require you to indemnify us for our own negligence or misconduct, and it does not apply to claims about propane, equipment or Services, which are governed by your Account Paperwork and applicable law.

## 34. Release for third-party disputes

Your dealings with third parties that you find through or that are mentioned on the Site, including the provider of the My Account Portal, review platforms, social networks, equipment manufacturers and other websites, are solely between you and those third parties. To the fullest extent permitted by law, you release the American River Gas Parties from claims, demands and damages of every kind, known and unknown, arising out of or connected with any dispute between you and such a third party. This release does not apply to claims arising from our own conduct or from Services we provide, which are governed by your Account Paperwork and applicable law.

California Civil Code Section 1542. If you are a California resident, you waive California Civil Code Section 1542 with respect to the release in this Section, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This waiver applies only to the release in this Section and only to the extent permitted by law.

## 35. Force majeure

We are not responsible for any delay or failure to perform any obligation relating to the Site, or to respond to a Request, that is caused by events beyond our reasonable control, including wildfires, smoke and evacuation orders, winter storms, snow and ice, flooding, earthquakes and other natural disasters, road closures, public safety power shutoffs and other power outages, disruptions in propane supply or transportation, periods of unusually high demand, epidemics, acts of government, labor disputes, internet or telecommunications failures, failures of third-party service providers, and cyberattacks. Delays in providing propane or Services are addressed in your Account Paperwork and applicable law.

## 36. Informal dispute resolution

We would like to resolve any concern you have quickly and fairly, the way a family business should. Before filing a lawsuit about the Site or these Terms, you and we each agree to first try to resolve the dispute informally. The party raising the dispute should send the other a written notice that describes the dispute and the relief requested. Notices to us should be mailed to American River Gas Co., Inc., Attn: Dispute Notice, P.O. Box 4590, Newcastle, CA 95658, with a copy emailed to info@americanrivergas.com. We will send notices to you at the email or mailing address you have given us. For 30 days after the notice is received, the parties will negotiate in good faith to try to resolve the dispute. If the dispute is not resolved within that period, either party may proceed as described in Section 37.

This informal process does not prevent either party from seeking emergency or temporary relief from a court to stop ongoing harm, and it does not extend or shorten any statute of limitations except as allowed by law. Nothing in these Terms requires you to arbitrate a dispute or waives your right to participate in a class action. Disputes about propane, equipment or Services are governed by your Account Paperwork and applicable law.

## 37. Governing law and venue

Governing law. These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-laws principles that would require the application of another jurisdiction's laws.

Venue. Subject to Section 36, any lawsuit arising out of or relating to these Terms or the Site must be brought exclusively in the Superior Court of California, County of Placer, or in the United States District Court for the Eastern District of California, and you and we each consent to the personal jurisdiction and venue of those courts and waive any objection that they are an inconvenient forum, to the extent permitted by law. This Section does not prevent either party from bringing an eligible claim in small claims court in Placer County, California.

## 38. Time limit to bring claims about the Site

To the extent permitted by law, any claim or cause of action arising out of or relating to these Terms or your use of the Site must be filed within one (1) year after the claim or cause of action arose. Otherwise, it is permanently barred. This time limit does not apply to claims about propane, equipment or Services, which are governed by your Account Paperwork and applicable law, or to any claim for which the law does not permit a shortened limitations period.

## 39. Assignment

You may not assign or transfer these Terms, or any of your rights or obligations under them, without our prior written consent. Any attempted assignment without consent is void. We may assign or transfer these Terms, in whole or in part, without restriction, including to an affiliate or in connection with a merger, acquisition, reorganization or sale of all or part of our business or assets. These Terms bind and benefit the parties and their permitted successors and assigns.

## 40. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable for any reason, that provision will be enforced to the maximum extent permissible or limited to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

## 41. No waiver

Our failure or delay in enforcing any right or provision of these Terms is not a waiver of that right or provision. A waiver is effective only if it is in writing and signed by us, and a waiver on one occasion is not a waiver on any other occasion.

## 42. Entire agreement

These Terms, together with our Privacy Policy, our Accessibility Statement and any additional terms presented to you for a particular feature or program, are the entire agreement between you and us about the Site, and they supersede any prior or contemporaneous understandings about the Site. As Section 10 explains, your Account Paperwork governs your account and the Services and controls over these Terms with respect to them. No statement by the Chat Assistant, and no oral statement, modifies these Terms.

## 43. Headings and interpretation

Section headings and lead-in phrases are for convenience only and do not affect the meaning of these Terms. In these Terms, the words "including," "include" and "for example" mean "including without limitation," the word "or" is not exclusive, the singular includes the plural and the plural includes the singular, and references to a Section are to a section of these Terms. No provision will be construed against a party because that party drafted it.

## 44. Notices

Notices to you. We may give you notices by email to the address you have given us, by mail, or by posting on the Site. Notices sent by email are effective when sent, and notices posted on the Site are effective when posted, unless the law requires otherwise.

Notices to us. Legal notices to us must be sent in writing by mail to American River Gas Co., Inc., P.O. Box 4590, Newcastle, CA 95658, with a copy emailed to info@americanrivergas.com. Notices to us are effective when received. For deliveries, account questions and other requests for Services, please call (530) 888-7438 rather than sending a notice. For a gas emergency, follow Section 5.

## 45. California consumer notice

The Site is provided free of charge. If you are a California resident and have a complaint about the Site, you may contact us as described in Section 48. California residents may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs. Your rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and under California's Shine the Light law are described in our Privacy Policy.

## 46. Survival

Any provision of these Terms that by its nature should survive the end of your use of the Site or the suspension of your access will survive, including Sections 5 through 8, 14, 17, 18, 21 through 25, and 31 through 45.

## 47. Changes to these Terms

We may revise these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date at the top. If a change is material, we will provide additional notice on the Site for a reasonable period. Revised Terms apply to your use of the Site after they are posted. They do not apply to a dispute of which we had actual notice before the change was posted. If you do not agree to the revised Terms, you must stop using the Site. Your continued use of the Site after revised Terms are posted means that you accept them.
